1. Agreement to these terms
By creating an account, purchasing a subscription or otherwise using OrderNow websites, applications or related services (collectively, the "Service"), you agree to these terms. Anyone accepting for a business confirms authority to bind that business.
2. Platform services
OrderNow provides configurable tools for digital menus, QR and online ordering, point-of-sale workflows, kitchen operations, inventory, reservations, reporting and related restaurant functions. Availability depends on the selected plan, market and implementation.
3. Accounts and authorized users
- Registration and business information must be accurate and kept current
- The account owner is responsible for credentials, permissions and authorized-user activity
- Account holders must be adults authorized to act for the relevant business
- Outlet and user limits follow the applicable subscription or written order form
4. Plans, fees and billing
- Free Plan: Access to designated entry-level features under current limits
- Paid Plans: Charged according to the billing cycle shown at purchase
- Pricing may change prospectively after reasonable notice where required
- Unused time is not automatically refundable unless required by law or a written offer
5. Responsible use
You must not use the Service to:
- Break applicable law or facilitate unlawful activity
- Upload malware, harmful code or content that compromises the Service
- Access another account, system or dataset without authorization
- Resell, sublicense or copy the Service except under an approved agreement
- Infringe intellectual property, privacy or other rights
6. Restaurant content and platform rights
- Business content: The restaurant retains its rights in menus, images, trademarks and other content it lawfully submits
- OrderNow materials: OrderNow and its licensors retain rights in the software, interface, documentation, branding and platform technology
- You grant the permissions reasonably required to host, process, display and transmit submitted content in order to provide the Service
7. Payments and third-party services
Payment processing, messaging, maps, hosting and other integrations may be supplied by third parties. Their terms, fees, availability and data practices may apply separately.
8. Data responsibilities and privacy
Our handling of personal information is described in the Privacy Policy. Each restaurant is responsible for required notices, lawful settings and its handling of guest data under applicable law.
9. Availability and changes
We work to keep the Service reliable, but uninterrupted or error-free operation is not guaranteed. Features may be maintained, improved, replaced or discontinued, with planned maintenance communicated when reasonably practical.
10. Disclaimers and limits of liability
To the maximum extent allowed by applicable law, OrderNow is not liable for:
- Indirect, special, incidental, exemplary or consequential loss
- Loss of profits, revenue, goodwill, opportunities or data
- Interruptions caused by networks, devices, third parties or events outside reasonable control
Where a monetary cap is permitted, aggregate liability relating to the Service will not exceed fees paid for the affected Service during the twelve months before the claim.
11. Suspension, cancellation and termination
You may cancel through the available account or billing process. Access may be restricted for non-payment, security risk, unlawful use or material breach. Data retention and export periods depend on the plan, legal duties and backup schedules.
12. Updates to these terms
These terms may be updated to reflect changes in the Service, business model or law. The revised version will state its effective date.
13. Applicable law and disputes
Applicable law, courts and dispute procedures may depend on the contracting entity, customer location and any written order form. The parties should first attempt good-faith resolution.
