1. Acceptance of Terms

By accessing or using OrderNow's digital menu and restaurant management platform ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part, you may not access the Service.

2. Description of Service

OrderNow provides a digital menu, ordering, kitchen display, point of sale, and restaurant management platform. Features available depend on your subscription plan.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining account security
  • You must be 18+ to create an account
  • One restaurant per account unless on Enterprise plan

4. Subscription Plans & Billing

  • Free Plan: Limited features, free forever
  • Paid Plans: Billed monthly or annually
  • Prices are subject to change with 30 days notice
  • No refunds for partial months

5. Acceptable Use

You agree NOT to:

  • Use the Service for illegal purposes
  • Upload malicious content or code
  • Attempt to access other users' accounts
  • Resell or redistribute the Service
  • Violate intellectual property rights

6. Content Ownership

  • Your Content: You retain ownership of menu items, images, and data you upload
  • Our Content: OrderNow owns all platform code, design, and branding
  • You grant us license to display your content within the Service

7. Payment Processing

Online payments are processed by third-party providers (Stripe, PayHere). We are not responsible for payment processor outages. Transaction fees are charged by payment processors, not OrderNow.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for compliance with data protection laws regarding your customers' data.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with advance notice when possible.

10. Limitation of Liability

OrderNow shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or data
  • Service interruptions beyond our control

Our total liability is limited to the amount you paid in the past 12 months.

11. Termination

You may cancel your account at any time. We may terminate accounts that violate these terms. Upon termination, your data may be deleted after 30 days.

12. Changes to Terms

We may modify these terms with 30 days notice. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by applicable laws. Disputes shall be resolved through arbitration when possible.
